Statement on COVID-19 and the human rights of persons with disabilities

The Committee on the Rights of Persons with Disabilities expresses its grave concern at the devastating impacts of the COVID-19 pandemic on persons with disabilities. The COVID-19 pandemic has revealed that the Convention on the Rights of Persons with Disabilities (CRPD) has not been comprehensively implemented by States Parties. It has starkly exposed the heightened vulnerability and risks to persons with disabilities that is underpinned by entrenched discrimination and inequality.

Persons with disabilities are often wrongly perceived to be inherently vulnerable, when it is attitudinal, environmental and institutional barriers that result in situations of vulnerability. While many persons with disabilities have health conditions that make them more susceptible to COVID-19, pre-existing discrimination and inequality means that persons with disabilities are one of the most excluded groups in terms of health prevention and response actions and economic and social support measures, and among the hardest hit in terms of transmission risk and actual fatalities.

COVID-19 pandemic highlights that protection, response and recovery efforts will not be effective unless everyone is equally valued and included. Critical and urgent action is required to ensure that those most at risk, including persons with disabilities are explicitly included in public emergency planning and health response and recovery efforts.

The CRPD outlines the normative legal standards to address discrimination and inequality, and these standards need to be integral to COVID-19 protection, response and recovery measures.

To this end, the Committee endorses the OHCHR guidance note, COVID-19 and the rights of persons with disabilities: Guidance and the UN policy brief, A Disability-Inclusive Response to COVID-19, and recalls the joint statement, Persons with Disabilities and COVID-19 by the Chair on behalf of the Committee and the Special Envoy of the United Nations Secretary-General on Disability and Accessibility’.

A human rights approach is critical to response and recovery efforts not only in relation to the COVID-19 pandemic, but also to ensure that States take action now to build equitable, sustainable and resilient societies that have the mechanisms to prevent and respond rapidly to future public health emergencies and to ensure that ‘no-one is left behind’.

CCD to track palliatives distribution in Kano and Kaduna States

The Centre for Citizens with Disability (CCD) says it will conduct a survey to track the distribution of palliatives amongst its members in Kaduna and Kano States.

The Director of the centre, Mr David Anyaele, said this on Tuesday at a virtual training conducted for its members in the two states.

Anyaele explained that the centre has the mandate of promoting human rights, demanding accountability and transparency, fighting corruption as well as fighting discrimination.

According to him, the centre will evolve a strategy to monitor the distribution of palliatives among its members in the two states.

He said that the centre used interpreters to ease communication and enable its members to take part in the survey.

While speaking on tools to be used in the survey, a consultant with the centre, Mr Godwin Unumeri, cautioned members on how to identify false information in order to abstain from gathering fake and false data during the survey.

Unumeri said the survey will be conducted soon, but he did not give a specific date.

CCD is an organisation of, and for persons with disabilities that works to educate, support and empower persons with disabilities and their families to maximise their potentials.

Established in 2002 in Lagos, CCD works to promote independent living, human rights and social inclusion of persons with disabilities in development efforts.

It was incorporated with the Corporate Affairs Commission Abuja as a charity organisation and it is recognised by Federal and States Ministries, Departments and Agencies in Nigeria as a credible NGO working on disability matters.

JONAPWD, ERPWDI seek an emergency meeting with NASS leadership over the Commission for Persons with Disabilities

A coalition of people living with disabilities has sought an emergency meeting with the leadership of the National Assembly on the need for the establishment of a National Commission for Persons with Disabilities.

The groups; Joint National Association of Persons With Disabilities (JONAPWD) and Equal Rights for Persons with Disabilities International, Inc. (ERPWDI), made their position known, on Tuesday, in Abuja.

In a letter written to request for an emergency bipartisan meeting with the leaders of the Senate and House of Representatives and a copy made available to newsmen, Miss Omotunde Ellen Thompson, Deputy Chairperson/Secretary, JONAPWD, and Chief Eric Ufom, President and Chief Executive Officer of ERPWDI, said it was time the persons living with disabilities were carried along on issues bothering on them.

“This is so because we, the Nigerians with disabilities, who wear the shoes, know where it pinches.

“It is our legal and constitutional rights to be in charge of the mandates set by the United Nations (UN) Convention on the Rights of Persons with Disabilities (CRPD) Article 4.3.

“It ensures that from the beginning to the end of every meeting whereby decisions of forming an independent, implementation commission for the Nigerians with Disabilities Act (NDA) are to be made, persons with disabilities must be represented.

“We hope that the government would respect this constitutional, civil, human, and disability rights given directly to us by the UN.

“We, therefore, humbly and respectfully request from the National Assembly to call for an emergency meeting, as they concluded on 7th April 2020 and extend invitations to each of our national disability leaders as mandated by the UN CRPD article 4.3, because nothing about us, without us,” they said.

According to them, this is in the interest of justice, due process, fair procedure, and equal protections for Nigerians with disabilities.

“Sir, please note that this request for emergency official legislative meeting on disability matters will equally be a lengthy narrative.

“This is because we agreed on everything said or written by ERPWDI; letters and petition dated 27th April 2020 and 13th May 2020.

“Therefore Sir,  I, Miss Omotunde Ellen Thompson, humbly and respectfully moves, under my official capacity to advocate for the new disability law,” the letter read in part.

President Muhammadu Buhari had, on Jan. 23, 2019, assented to Discrimination Against Persons with Disabilities (Prohibition) Act, 2018.

Section 31 of the Act provides for the setting up of the National Commission for Persons with Disabilities with Executive Secretary as the head.

Disability Commission: US based group urges FG for inclusion of persons with disabilities in its composition

The Federal Government has been urged to consider the inclusion of Nigerians with disabilities in the composition of the National Commission With Persons with Disabilities (NCPWD) so that the essence of the passing the law that established the Commission would not be lost on the real people that the law was originally set to liberate from societal challenges. This advice was contained in a statement circulated by the Founder of an American based pressure group that works towards making life easy for Nigerians with disabilities, Equal Rights for Persons with Disabilities International, Chief Eric Ufom who also has some form of disability.

He observed in the statement that the call on the government was imperative at this time while the membership of the Commission has not been made public.

He insisted that his organisation which had played a pivotal role in the process of working on the law on the establishment of the Commission because we the Nigerians with Disabilities who wear the shoes and knew where they pinch us.

” It is our legal and constitutional rights to be in charge under the mandates set by the UN CRPD Article 4.3, from the onset to the end of every, meeting whereby decisions of forming an Independent, implementation Commission for the Nigerians with Disabilities Act (NDA), are to be made and we hope that Government should respect this constitutional, civil, human and disability rights given directly to us by the United Nations.

“It is a year and six months since the President signed the law to establish the National Commission for Persons with Disabilities and we have not heard anything about the Commission from the government.

“This is despite the enormous challenges ahead of the Commission and the rising number of Nigerians with genuine needs to be addressed.

“We were originally at the over thirty-one million Nigerians with disabilities but the society has forced ten million members of the society to join us due to their being labelled as Almajiris.

“Just recently, the failure of the government to provide security across the country has led to humanitarian problems that have made over ten million Nigerians lose their shelter and become disabled by being labelled internally displaced persons.

“We appreciate the role the National Assembly has played so far to ensure that the Law for the establishment of the Commission was followed to its logical conclusion with the signing of the law by President Muhammadu Buhari in January 2019.

“Considering the manner Nigerians with Disabilities were abandoned during the sharing of the COVID-19 palliatives recently, we have a fair idea of how they would still be abandoned if they are not given a fair representation in the Commission that is being set up to make life easy for them.

“Our Nigerians with Disabilities national leaders that include, Barr. Abdulsalam Idowu Kamaldeen, Legislative Aide to the Speaker of the House of Representatives on Disability Matters, Dr Samuel Odeh Ankeli, SSA to the President on Disability Matters, Alhaji Mishbahu Lawan Didi, APC Disability National Leader, SA to the President on Disability Matters, the Presidency’s Disability Desk Officers at the SGF and Head of the Civil Service of the Federation,  The JONAPWD’s (1) Prince Paul Adelabu, Chairman, (2) Miss Omotunde Ellen Thompson, Deputy Chairperson/Secretary; (3) Mr. Usman Nahuche (member) and (4) Miss Ene Ede (member), has not ever been contacted by the Minister of Humanitarian Affairs, Disaster Management and Social Development, which confirmed the valid observation and conclusions made by both the Senate President and Hon. Speaker of the House of Representatives on 7th April 2020.

“We, therefore, wish to humbly and respectfully request from the National Assembly to call for an emergency meeting, as they concluded on 7th April 2020 and extend invitations to each of our National Disability Leaders as mandated by the UN CRPD article 4.3, because Nothing About Us, Without Us, in the interest of justice, due process, fair procedure and equal protections constitutional safeguards for Nigerians with Disabilities.

” In setting up the Commission for People with Disabilities in Nigeria, we, therefore, wish to urge the government to abide by the  United Nations Human Rights Mandate on such establishments around the world.

“The laid down procedure understands the fact that Government always makes wrong decisions for persons with disabilities, therefore, there was a need to put a permanent stop to it and mandated that Government must abide by their obligations under the treaty and fully obey and comply by Article 4.3, which Nigeria has refused to comply with so far.

“There was a very serious valid, arguable and verifiable reason(s) why the UN Treaty mandated on its Article 4.3 that, In the development and implementation of legislation and policies to implement the present Convention, and in other decision-making processes concerning issues relating to persons with disabilities, States Parties shall closely consult with and actively involve persons with disabilities, including children with disabilities, through their representative organizations.” Nothing About Us, Without Us. ” the non-profit group stated.

Man Arraigned For Allegedly Raping Physically Challenged Girl In Ogun

A 35-year-old man, Oluwafemi Kehinde, was on Tuesday arraigned in an Ota Magistrates’ Court in Ogun, for allegedly raping a physically challenged girl (name withheld).

Kehinde, who lives at No.36 Success Street, Abule Isale, Ilogbo Road, Ota, is facing a count charge of raping.

The Prosecutor, Insp. E.O. Adaraloye told the court that the defendant committed the offence at his residence at about 10.30 p.m. on Feb. 12.

Adaraloye said that the defendant had unlawful carnal knowledge of the complainant, by using his manhood to caress her private part, knowing fully well that she is a physically challenged person.

He said that the offence contravened Section 360 of the Criminal Code Vol.1, 2006.

The defendant, however, pleaded not guilty to the charge.

The Magistrate, Mrs A.O. Adeyemi granted him bail in the sum of N50,000 with two sureties in like sum.

Adeyemi also ordered that the sureties must reside within the court’s jurisdiction and be gainfully employed with an evidence of tax payment to Ogun Government.

She adjourned the case until June 19 for trial.

New app helps people monitor COVID-19 symptoms from home and identify mental health needs

A new app that helps patients in self-isolation monitor for symptoms of coronavirus (COVID-19) and identify their mental health needs has been developed by a team of medical and digital experts.

CovidCare provides self-monitoring support to patients with symptoms or a diagnosis of COVID-19 by measuring things such as their heart rate, body temperature and shortness of breath.

The app also asks users questions about their emotional needs and how they are coping, providing researchers with critical information about the impact of self-isolation on mental health due to COVID-19.

Led by researchers at the University of Melbourne’s Department of General Practice, a clinical trial is now rolling out to test the safety and efficacy of the app. COVID-19 positive or symptomatic patients at participating respiratory clinics nationally will use the app to regularly monitor their symptoms as well as their mental health during self-isolation.

A sub-study will also be conducted to understand the emotional needs of people during self-isolation to help inform the effective management for mental health and wellbeing.

University of Melbourne Associate Professor Victoria Palmer said these results will inform government, research and industry responses to future pandemics of this kind.

“This pandemic has changed the way we interact with others, and self-isolation will be a part of our lives as long as the pandemic continues,” Associate Professor Palmer said. “We urgently need to document the mental health impacts for people and provide further support in the home context.”
Researchers from Swinburne University are also involved in the study, in collaboration with digital product company Two Bulls and clinicians Dr Mukesh Haikerwal, Associate Professor Jeremy Goldin, and Professor Bruce Thompson.

“CovidCare is a tool that supports patients and clinicians,” said Two Bulls Chief Executive Officer James Kane.

“It puts patients in a position to confidently and correctly clarify the history of their symptoms should they make the decision to visit a doctor. It is a simple tool to monitor the symptoms of COVID-19 on a regular basis that can help people to feel more in control.”

The team is exploring how remote health tools like CovidCare could change the landscape of the primary care sector in the long term.

“Apps and other digital means could be used for a range of chronic conditions, including targeted interventions for influenza, diabetes and painful skin conditions such as cellulitis,” said senior respiratory physician Associate Professor Goldin.

COVID-19 palliative: FG donates Five Trucks of Food Items to Nasarawa govt, PWDs to benefit

The federal government has given five trucks of food items as palliatives to the Nasarawa State Government Monday, June 8, 2020.

The said food items, which comprise three trucks of rice, one truck each of tinned tomatoes and groundnut oil, were meant to be distributed to vulnerable persons across the state to cushion the hardship brought about by movement restrictions put in place to curb the further spread of the Covid-19 pandemic.

A detailed list of the food items included 1,800 bags of rice, 2,500 cartons of Tomapep, and 600 kegs of groundnut oil to be distributed to the poor, vulnerable, and people with disabilities.

The Deputy Governor, Dr. Emmanuel Akabe, thanked the Minister of Humanitarian Affairs, Disaster Management, and Social Development, Hajiya Sadiya Umar Faruq, on behalf of the state government for the gesture, promising to distribute the items to the targeted beneficiaries as they had received the palliatives.

Akabe also appreciated the efforts of both the federal and state governments in facing one of the deadliest challenges confronting the world at the moment, reiterating the support of the state government in the fight against Covid-19.

The delegation from the federal government was led by the Director, Legal Services of the Federal Ministry of Humanitarian Affairs, Disaster Management, and Social Development, Mrs. Laurat Ajima Elayo, who represented the minister.

COVID-19 Palliative: US based NGO brings succor to women with disabilities in FCT

The Executive Director of The Qualitative Magazine (disability advocacy magazine) Chris Agbo on behalf of Princess Eunice Ukwuani Foundation in collaboration with Lotus Initiative for the Blind on Saturday and Sunday distributed food items to 50 women with disabilities in Abuja.

The Qualitative magazine team led by Comrade Chris Agbo embarked on distribution of relief materials tour to Bwari Area council to Kuje Area Council and ended it at Abuja Municipal Area Council.

Different clusters of disability such as persons with physical disabilities, deaf, blind, persons with albinism and persons with intellectual disabilities were considered during the distribution.

Each of them got one cartoon of noodles and one 5kg bag of rice.

Chris Agbo during a press time said that Princess Eunice Ukwuani Foundation in collaboration with Lotus Initiative for the blind contacted The Qualitative Magazine to help distribute palliatives to women and girls with disabilities, as a disability focused magazine, it is also our duty to mobilize relief and other means of livelihood for persons with disabilities. Knowing the effect of COVID-19 on persons with disabilities especially women and girls with disabilities, we took up the task of providing this essential service. The foundation has been donating PPE for materials, face masks and hand sanitizers to hospitals in Nigeria, USA and some countries in Africa to help curb the spread of COVID-19, but now, they are kicking off the provision of palliatives for women and girls with disabilities to help them survive this trying time, for the fact that, women with disabilities suffer more challenges than the male counterpart. It is imperative that they are reached at a time like this. Speaking further, he said that it is an ongoing exercise and he called on other good spirited Nigerians home and abroad to support this foundation to reach out to more women and girls with disabilities across the country. There are very many of women with disabilities who are in the rural areas.

Ruth Ali, a blind from Bwari in FCT expressed her joy on the gesture, prayed for God to bless the foundation and urge the public to support the initiative for the NGO to go forward and reach people in the remotest part of the country.

Betty Mube, Joint National Association of Persons with Disabilities (JONAPWD) FCT chapter, women leader, and a physically challenged speaking on behalf of all women with disabilities thanked the foundation for remembering women with disabilities at this time of COVID-19 is ravaging the world and she made a passionate appeal to Nigerians at home and in diaspora to donate to the foundation because they are committed to uplift the lives of women with disabilities.

Princess Eunice Ukwuani Foundation is founded by USA based Nigerian, Princess Eunice Ukwuani. It is a global foundation that caters for the needs of the girl-child and women with disabilities in Africa and around the world, It is basically founded to cater for education needs of the girl-child that can’t afford to go to school and also financial needs of vulnerable children that is affected by the COVID-19 Pandemic. Mallam Tasiu Shehu Garko, a person with disability has been appointed as the new Senior Special Assistant (SSA) on Disabled Matter by Kano State Governor, Dr Abdullahi Umar Ganduje

Mallam Garko replaces Hon. Adnan Aliyu who lost his job because he has not done well in the development of disability community since his appointment as the SSA on Disability Matters in the governor’s first term in the office.

Aliyu removal came as a result of protest from some group of Persons with Disabilities (PWDs) against his reappointment as SSA on Disabled Matters in this second term in office of the governor.

The Governor yielded to their call and replaced Aliyu with Garko as his new aide on Disability matters.
